Philip became an Ensign in the 17th Regiment of Foot (Leicestershire) on 2nd September 1813 and was promoted Lieutenant on 16th April 1819. He progressed to Captain on 16th June 1825 and Major in 1833. He left the UK on 19th September 1830 with his regiment for New South Wales where he served until 1835. He also served as a magistrate at Maitland, NSW between 1831 and 1836.

In one of his more memorable cases (Rex v Foley, 1831) he examined the principal witness, William Ledgerwood. Foley had been indicted for raping Sarah Holding but when called upon to be sworn she refused. Foley was found not guilty and Holding was committed for contempt of court. He is recorded returning to UK on 20th February 1836 as Officer in charge of invalid soldiers on board the Roslyn Castle but later returned to his family in Australia. He is reputed to have been a brutal and detested man.
