The Burnley Express of 1st April 1882 carried the following obituary:

"It is with regret we have to announce the death of Maj. Charles Hamilton Fenton, late of HM 53rd and 9th Regiments, which event took place on the 27th February at Linden House, Lymington, at the age of 61 years.

The deceased will be well remembered by many in Burnley, as the adjutant of the 5th Royal Lancashire Militia, a post which he occupied for many years to the great advantage of the regiment. Old volunteers will also call to mind the great efforts he brought to bear in furthering the volunteer movement in the town at the time of the formation of the 3rd LRV, and he will be ever remembered with honour and respect by those with whom his position brought him in contact".

The records are slightly confusing but it is likely that Charles became an Ensign by purchase on 12th April 1839 and a lieutenant, again by purchase, on 23rd January 1846. He was promoted Captain in the 9th Foot from the 53rd Foot on 6th August 1847 and listed amongst the Commissions signed by the Lord Lieutenant of the County Palatine of Lancashire, in respect of 5th Regiment of Royal Lancashire Militia to serve as Adjutant with the rank of Captain from 18th April 1853. He was also the author of 'The Rudiments of Rifle Practice; or A System of Catechetical Instruction in Preliminary Musket Drill' published in 1861 by Simpkin Marshall & Co.

Charles' father was Captain Thomas Charles Fenton who was born in 1790 and joined the Dragoons at the age of 14 at the rank of Cornet. He served in Spain and Portugal during the Peninsular War and later transferred to the 2nd Dragoons, or Scots Greys, and commanded troops at the Battle of Waterloo. He married Harriet Rooke in 1817 and retired from the army two years later. They had at least one daughter, Fanny as well as Charles who was baptised at Tidenham, it is said in 1827 though this is later than would have been expected. Harriet died in 1827 and in 1830 Capt. Fenton married Anne Kensington of Tutshill House. They had one daughter, Ellen who was born 10 days after her father's death in 1841.
